This Acceptable Use Policy (“AUP”) governs your use of the managed WordPress hosting services (“Services”) provided by WPCloud Inc. (“WPCloud,” “we,” “us,” or “our”). This AUP is incorporated into and forms part of our Terms of Service. By using our Services, you agree to comply with this AUP.
WPCloud reserves the right to modify this AUP at any time. Material changes will be communicated via email or posted on our website. Continued use of the Services after notification constitutes acceptance of the modified AUP.
1. Prohibited Activities
You may not use our Services to engage in any of the following activities:
- Illegal activity: Any activity that violates Canadian federal, provincial, or municipal law, or the laws of the jurisdiction in which you reside or operate
- Malware distribution: Hosting, distributing, or linking to viruses, trojans, ransomware, spyware, or any other malicious software
- Phishing and fraud: Hosting phishing pages, advance fee schemes, or any content designed to fraudulently obtain personal information or financial details
- Network attacks: Conducting or facilitating denial-of-service (DoS) attacks, distributed denial-of-service (DDoS) attacks, port scanning, packet sniffing, or any other form of network reconnaissance or disruption against any system
- Spam and unsolicited communications: Sending unsolicited bulk email, spam, or any communications in violation of Canada’s Anti-Spam Legislation (CASL) or comparable international legislation
- Cryptomining: Using server resources for cryptocurrency mining or similar computationally intensive activities unrelated to your hosted WordPress site
- Proxy and relay services: Operating open proxies, open relays, anonymous remailers, or TOR exit nodes on our infrastructure
- Resource abuse: Intentionally consuming excessive server resources (CPU, memory, I/O, or network bandwidth) in a manner that degrades service for other customers on shared infrastructure
2. Prohibited Content
You may not host, store, distribute, or link to the following types of content on our Services:
- Child sexual abuse material (CSAM) or any content that sexualises minors
- Content that promotes or incites violence, terrorism, or hatred against individuals or groups based on race, ethnicity, religion, gender, sexual orientation, disability, or nationality
- Non-consensual intimate imagery
- Pirated software, media, or other copyrighted material distributed without authorisation
- Counterfeit goods or fraudulent product listings
- Content that infringes on trademarks, patents, trade secrets, or other intellectual property rights
- Defamatory or libellous content
- Content that facilitates the sale of controlled substances, illegal drugs, or unregulated pharmaceuticals
- Gambling sites operating without appropriate Canadian or provincial licences
Streaming restriction: Our hosting plans are designed for WordPress websites and web applications. Using our infrastructure primarily as a streaming media server (audio or video streaming to a large concurrent audience) is not permitted without prior written approval. Standard embedded video and audio content hosted on third-party platforms (YouTube, Vimeo, etc.) is permitted.
3. Email and Electronic Communications
All email sent through our infrastructure must comply with Canada’s Anti-Spam Legislation (CASL). Specifically:
- You must have express or implied consent from each recipient before sending commercial electronic messages
- All commercial messages must include accurate sender identification
- All commercial messages must include a functioning unsubscribe mechanism
- Unsubscribe requests must be honoured within 10 business days
- You must not use deceptive subject lines or misleading header information
- You must maintain records of consent for each recipient
- You must not harvest email addresses from websites, forums, or other online sources without the owner’s consent
Transactional email (order confirmations, password resets, and similar service-related messages) is provided via MailChannels. The daily sending limit is 2,000 messages per account. If you require higher volume, contact our support team to discuss options.
4. Vulnerability Testing
You may not conduct vulnerability scans, penetration tests, or security assessments against our infrastructure or any other customer’s hosted services without prior written authorisation from WPCloud. If you wish to conduct security testing on your own hosted site, you must submit a request to our support team at least 5 business days in advance, specifying the scope, methods, and duration of the proposed testing.
5. Automated Access
Automated access to our Services (bots, crawlers, scrapers, or automated scripts) must comply with industry-standard robots.txt directives and must not impose an unreasonable load on our infrastructure. We reserve the right to rate-limit or block automated access that degrades service quality for other customers.
6. Shared System Resources
Our shared hosting plans provide access to shared server resources. You agree not to consume resources in a manner that adversely affects other customers. If your site consistently exceeds the resource allocation of your plan, our team will contact you to discuss an upgrade to a plan with more resources. We will never suspend a site without warning for resource usage, except in cases where the usage constitutes abuse or poses a security risk.
7. Intellectual Property
You are solely responsible for ensuring that the content you host on our Services does not infringe on the intellectual property rights of any third party. WPCloud responds to valid notices of copyright infringement in accordance with Canadian copyright law. If you believe that content hosted on our Services infringes your intellectual property rights, please contact us at hello@wpcloud.ca with a detailed description of the alleged infringement.
8. General Requirements
You are responsible for:
- Keeping your WordPress installation, plugins, and themes up to date (WPCloud handles this as part of our managed service, but you must not disable or interfere with our update processes)
- Maintaining strong passwords and securing access credentials
- Ensuring that any third-party software, plugins, or themes you install are obtained from legitimate sources and do not contain malicious code
- Responding promptly to any security or compliance notifications from WPCloud
9. Enforcement
WPCloud reserves the right to take any action we deem appropriate in response to violations of this AUP, including but not limited to:
- Issuing a warning and requesting remediation within a specified timeframe
- Temporarily suspending access to the affected site or account
- Removing or disabling access to prohibited content
- Permanently terminating your account
- Reporting illegal activity to the appropriate law enforcement authorities
Where possible, we will provide notice before taking enforcement action. However, we reserve the right to act immediately without notice in cases involving illegal activity, security threats, or imminent harm to our infrastructure or other customers.
